1/ Shipping and Returns

All orders are shipped F.O.B. from our warehouse in Florida. Our preferred shippers are UPS and USPS; all orders are shipped fully insured. Orders will not be invoiced until the time of actual shipment at which time full payment is due unless other arrangements have been made. In some cases orders may be partially invoiced and shipped pending item availability. At the time of shipment, an email notification will be sent with tracking information. C.O.D. orders will receive an additional pre-alert with full invoice information.

Upon receiving an order, please thoroughly inspect all packages to ensure all invoiced items have been received intact. In the rare case where an order may arrive damaged or incomplete, please save all items and original packaging and contact BTC immediately.

 

All claims must be made in writing to BTC with seven (7) business days of receipt of any shipment, after which the order will be deemed accepted and no longer qualify for product replacement or refund.

2/ Privacy Notice

BTC Distinguished French Gifts, Inc. and their respective partners are the sole owners of the information collected on this Web site. We only gather information we need to serve you better and will not - without your consent, sell, share, or rent this information to others in ways different from what is disclosed in this statement except in cases where in good faith we believe that the law requires us to do so, it is necessary to protect BTC Distinguished French Gifts, Inc.'s rights and/or property, or if circumstances necessitate acting to protect the personal safety of staff or of the public.

BTC does not publish or in any way share with third parties any information pertaining to our reseller customers except in cases where we are contacted by an interested consumers wishing to purchase our products. In these circumstances, it is BTC's policy to direct the interested consumer to the closest retail merchant carrying the product. If you do not agree to your information be shared on this limited basis, please contact us to opt out. Also, from time to time BTC will conduct marketing campaigns in various advertising venues. We will however, never disclose the name, location, or contact information of a reseller in any marketing ventures without first notifying and receiving written consent from the reseller.

Standard Terms and Conditions

Customer agrees that all orders shall be subject to the following standard terms and conditions.

 

           Payment Terms

Unless payment in advance is required, payment is due thirty (30) days after the date of BTC Distinguished French Gift Inc.’s (hereinafter referred to as “BTC”) invoice. BTC shall invoice Customer for the purchase price of the product ordered, any applicable taxes, duties or tariffs, and any applicable shipping, handling or insurance charges incurred upon shipment. Any payments not made within such thirty (30) day period will be subject to an interest charge of fifteen percent (15%) per month or the maximum rate allowed by applicable law, whichever is less. Customer may not cancel any order without BTC’s prior written agreement. If BTC charges or receives any excess interest, it shall be deemed a mistake. BTC will automatically conform to applicable law, and if excess interest has been received, BTC will refund the excess to Customer. In addition, if any cancellation causes any additional expenses to be incurred by BTC, a cancellation charge covering these expenses will be charged to Customer.

           Shipment and Acceptance

All prices are F.O.B. BTC's shipping point. We reserve the right to partially ship items on a given purchase order pending product availability. Orders are shipped via BTC's recommended carriers. High value shipments will be charged a nominal insurance fee. Upon receipt of goods, Customer must inspect all aspects of the shipment and notify BTC in writing of any inaccuracy or defects. Such notification must be received by BTC within seven (7) days after receipt of goods by Customer at which time the goods shall be deemed accepted by Customer. Customer' s exclusive remedy and BTC's sole obligation in the event any shipment is inaccurate or defective is, at BTC's option: (i) a refund of the fee paid to BTC for such shipment (exclusive of shipping and handling charges), or (ii) replacement of the material shipped. BTC reserves the right to cease shipment of any order for any customer who has outstanding past due invoices or has breached any of the terms and conditions set forth herein.

Customer agrees to acknowledge BTC and any contributor indicated by BTC as the source of any material shipped hereunder in all publications that reference or arise out of the material shipped hereunder. If required by the contributor indicated by BTC, BTC may inform such contributor of Customer' s identity.

Miscellaneous

These terms and conditions shall be governed and construed in accordance with the laws of the State of Florida, without reference to its conflicts of law rules. If Customer is located outside the U.S., the parties exclude in its entirety the application of the United Nations Convention on Contracts for the International Sale of Goods. All terms and conditions of this Agreement are severable. If any term or provision, or any portion thereof, of this Agreement is held to be invalid, illegal or unenforceable, the remaining portions shall not be affected. Customer acknowledges and agrees that these terms and conditions shall govern the purchase of any and all products of BTC by Customer, and none of the provisions set forth in any purchase order or any BTC acknowledgement thereof (either printed, stamped, typed or written), if any, shall be applicable to such purchase. Sole and exclusive venue for jurisdiction shall be in the State of Florida.
